¿Interpretaciones no vinculantes de un "Supremo Intérprete"? Reflexiones sobre el rol del tribunal constitucional peruano a propósito de una reciente modificación de su reglamento normativo

Abstract

Este ensayo toma como base la modificación del artículo 10º del Reglamento Normativo del Tribunal Constitucional peruano para analizar un problema de fondo: las distinciones entre los tipos de sentencias que dicta el Tribunal Constitucional (precedentes vinculantes, jurisprudencia constitucional, sentencias interpretativas). Se sostiene que dicha distinción debilita la categoría y el rol de máximo intérprete de la Constitución que ostenta en la actualidad el Tribunal Constitucional. Y se argumenta que la tipología de fallos es contradictoria con ese rol.

ABSTRACT: This paper builds on the amendment ofArticle 10 of the Normative of the Peruvian Constitutional Court to analyze a problem: the distinctions between the types of decisions handed down by the Constitutional Court (binding precedent, constitutional jurisprudence, interpretative rulings). It is held that this distinction undermines the status and role of Supreme Interpreter of the Constitution which currently holds the Constitutional Court. And it is argued that the type of decisions is inconsistent with that role.
