El Informe Jurídico analiza el proceso judicial instaurado por la señora G.C.C contra su
ex empleadora D.S.A., con el propósito de obtener una indemnización por los daños y
perjuicios originados a su persona, a causa de verse forzada a renunciar producto de
una denuncia por el delito de hurto sistemático presentada por representantes de la
empresa D.S.A.. Siendo tramitada la causa en vía ordinaria laboral, la primera
instancia resolvió declarar fundada en parte la demanda y se ordenó a la empresa
D.S.A. al pago de una indemnización por el daño moral causado a la demandante, a
causa de atribuírsele un delito que no habría cometido, mancillándose así su honra y
buena reputación frente a sus compañeros de trabajo y a la sociedad; sin embargo,
respecto al daño emergente y lucro cesante, se resolvió infundada en dicho extremo,
por no haberse acreditado el empobrecimiento, pérdida o sustracción del patrimonio de
la demandante, así como por no haberse acreditado en el proceso que la recurrente
haya sido coaccionada a renunciar, por lo que no existe lucro cesante originado por la
conducta antijurídica de la demandada. En dichas circunstancias, la demandada
interpone recurso de apelación ante la 4ta Sala Laboral Permanente, al considerar que
el Juez de primera instancia no habría valorado las pruebas ofrecidas que acreditan
que la demandada no interpuso denuncia directa por hurto sistemático hacia la
demandante, sino que solo se limitaron a poner en conocimiento de las autoridades
competentes, el delito que habrían sufrido; en la que la demandante era solo una de
las implicadas por el cargo que ostentaba, así como por no haberse acreditado en
instancia judicial la afectación de la imagen de la demandada, y por tanto el daño
moral que habría sufrido. Revisada la causa por la Sala Laboral, se declaró fundada la
apelación, al no encontrar medio probatorio alguno que acredite el malestar sufrido por
la demandante y el nexo de causalidad entre los hechos cometidos por la demandada
con la renuncia de la actora a su contrato de trabajo. Ante lo resuelto en segunda
instancia, la demandante presentó recurso extraordinario de Casación contra la
Sentencia de Vista, por las causales de infracción normativa a dispositivos del Código
Civil y Código Procesal Civil; sin embargo, la Corte Suprema, advirtiendo la pretensión
de la actora para que se re examine los hechos aportados en el proceso, la declararon
improcedente.
