El perfeccionamiento del contrato entre ausente. Un análisis al artículo 1374 del código civil

Abstract

La elaboración y contenido del presente artículo se fundamenta sobre la base de la normativa del derecho civil, y se consolida específicamente en el ámbito de los contratos. Nuestro preponderante objeto radica en la perspectiva que pretendemos brindar a la formación de los contratos entre ausentes, a través del estudio y análisis del consentimiento, así como a la revisión de las teorías de la recepción y conocimiento, como fundamentos de este tipo de contratación. Para efectuar nuestro objetivo revisaremos y detallaremos el seguimiento del título I del libro Fuentes de las Obligaciones de nuestro Código Civil vigente art. 1352 (perfección de contratos), art. 1358 (contratación directa de incapaces) y el título II, en los art. 1373 (perfeccionamiento del contrato), art. 1374 (condicionamiento y contratación entre ausentes), así como la doctrina pertinente. Como resultado de nuestra investigación y análisis, proponemos un nuevo alcance entre lo establecido en el Código Civil y lo recopilado de las diversas doctrinas, a fin de poder obtener una nueva perspectiva que brinde una mejor resolución en el ámbito de la contratación entre ausentes, que sea congruente con nuestro sistema legislativo, y afín a las nuevas tendencias jurídicas y tecnológicas.

The production and content of the present article, it is based on the base of the regulation of the civil law, and is consolidated specifically in the area of the contracts. Our preponderant object takes root in the perspective that we try to offer to the formation of the contracts between absent, across the study and analysis of the assent, as well as to the review of the theories of the receipt and knowledge, as foundations of this type of contracting. To effect our aim we will check and detail the follow-up of the title I of the book Sources of the Obligations of our civil in force Code art. 1352 (perfection of contracts), art. 1358 (direct contracting of incapable) and the title II, in the art. 1373 (development of the contract), art. 1374 (conditioning and contracting between stay away), as well as the pertinent doctrine. As result of our investigation and analysis, we propose a new scope between the established in the Civil Code and the gathered of the diverse doctrines, in order is able to obtain a new perspective that offers a better resolution in the area of the contracting between absent, that is coherent with our legislative, and related system to the new juridical and technological trends.
